Definitions

• “Bin Dasmal General Trading,” “Us,” “We,”, “Company” or “Our” means Bin Dasmal General Trading Co. • “USER”, “You” means the user of the Website.

• “Chargeback“: means where a customer or You (as applicable) using the online payment option in the website makes a complaint to his/her card issuer bank that a transaction is disputed and/or fraudulent.

• “Transaction Charges“: means any fees levied by a bank or financial institution upon processing a valid refund request to You or a customer (as applicable) which may vary from case to case.

• “Website“: means the Bin Dasmal General Trading Co. LLC website.

Scope

1. These General Terms and Conditions for Online Payments (hereinafter referred to as “General Terms”) apply to all payments done through Bin Dasmal General Trading Co. LLC’s website.

2. These General Terms shall apply exclusively. Bin Dasmal General Trading Co. LLC does not accept any conflicting or deviating terms and conditions unless this has been agreed in the individual case with a legal representative of Bin Dasmal General Trading Co. LLC in writing.

3. These General Terms apply equally to commercial entities and consumers.

Processing

1. In these Terms and Conditions the term “Charge Back” shall mean, approved, and settled credit/debit card payment transaction(s), which are at any time refused, debited, or charged back to merchant account (and shall also include similar debits to Payment Service Provider’s accounts, if any) by the acquiring bank or credit card company, for any reason whatsoever, together with the bank fees, penalties and other charges incidental thereto.

2. Server Slow Down/Session Timeout: In case the Website or Payment Service Provider’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slowdown’ or ‘failure’ or ‘session timeout’ You shall, before initiating the second payment, check whether Your Credit/Debit Card has been debited or not and accordingly resort to one of the following options:

   • In case the Credit/Debit Card appears to be debited, ensure that You do not make the payment twice and immediately thereafter contact the company via email or any other mode of contact as provided by the company to confirm payment.

   • In case the Credit/Debit Card is not debited, You may initiate a new transaction to make payment.

   • However, You agree that under no circumstances The Company or The Payment Gateway Service Provider shall be held responsible for such fraudulent/duplicate transactions, and hence no claims should be raised to Payment Gateway Service Provider or The Company.

   • No communication received by the Payment Service Provider(s) in this regard shall be entertained by the Payment Service Provider(s).

3. The Company and the Payment Service Provider(s) assume no liability whatsoever for any monetary or other damage suffered by You on account of:

   • The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Payment Gateway or Services in connection thereto; and/ or,

   • Any interruption or errors in the operation of the Payment Gateway.

4. You agree, understands, and confirm that Your personal data including details relating to debit card/ credit card transmitted over the Internet may be susceptible to misuse, hacking, theft and/ or fraud and that the Company or the Payment Service Provider(s) have no control over such matters.

5. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by You, the Company does not represent or guarantee that the use of the Services provided by/ through it will not result in theft and/or unauthorized use of data over the Internet.

6. The Payment Service Provider(s) and its affiliates and associates shall not be liable, at any time, for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on the Website.

Debit/Credit Card Details

1. Bin Dasmal General Trading Co. LLC reserves the right to exclude or include particular payment methods at any time.

2. In case of payment by credit/debit card, Your payment will be executed by Bin Dasmal General Trading Co. LLC’s payment service provider using their discrete secure infrastructure. Bin Dasmal General Trading Co. LLC’s payment service provider reserves the right to decline the processing of payments in cases of suspected fraud or other irregularity.

3. You represent that you have valid rights and title in any and all Contents/Credit or Debit Card details that you submit on the Site, that you have not infringed on any right over the same belonging to any party and further that you will indemnify Bin Dasmal General Trading Co. LLC or its affiliates for all claims arising out of any content/Credit or Debit Card details that you post on the Site.

4. Bin Dasmal General Trading Co. LLC will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to ‘prove otherwise’ shall be exclusively on the user.

5. You may pay Your payment to the Company by using a debit/credit card. You warrant, agree and confirm that when You initiate a payment transaction and provide Your card details:

   • You are fully and lawfully entitled to use such credit / debit card for such transactions;

   • You are responsible to ensure that the card details provided by You are accurate;

   • You are authorizing debit of the nominated card for the payment by You along with the applicable Fees.

   • You are responsible to ensure sufficient credit is available on the nominated card at the time of making the payment to permit the payment of the dues payable by You inclusive of the applicable Fee.

Payment Gateway Disclaimer

Any pay-out is subject to Your completion of Bin Dasmal General Trading Co. LLC’s Payments registration process. Bin Dasmal General Trading Co. LLC’s Payments Terms and Conditions shall govern such Payments. This needs to be incorporated by reference. Mainly, any payment shall be connected to the Payment Providers and shall be governed by such Payment Provider’s terms of service. Bin Dasmal General Trading Co. LLC is neither a party to nor is responsible in any way for Your relationship with Your payment providers, such as card issuers, or for the actions of any of these payment providers.

The Service is provided in order to facilitate access to view and pay online. The Company or the Payment Service Provider(s) do not make any representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified in the Website for this purpose. By accepting/ agreeing to these Terms and Conditions, You expressly agree that Your use of the aforesaid online payment Service is entirely at own risk and responsibility of You.

Payment Refund Policy for Online Payments

Refund for Charge Back Transaction: In the event there is any claim for/ of charge back by You for any reason whatsoever, You shall immediately approach the Company with Your claim details and claim a refund from the Company alone. Such refund (if any) shall be affected only by the Company via payment gateway or any other means as the Company deems appropriate. No claims for refund/ chargeback shall be made by You to the Payment Service Provider(s), and in the event such claim is made, it shall not be entertained.

Refund for fraudulent/duplicate transaction(s): You shall directly contact the Credit/Debit Card issuing Bank for any fraudulent transaction(s) on account of misuse of Card/ Bank details by a fraudulent individual/party, and such issues shall be suitably addressed by the Credit/Debit Card issuing Bank alone in line with their policies and rules.

Refund Policy

This Refund Policy only applies to payments collected by Us through online payment gateway. The refund amount will be arrived at after deducting the relevant charges incurred by Bin Dasmal General Trading Co. LLC as banking charges, payment gateway charges, and any other such charges.

It is important that You read this Refund Policy carefully. You should familiarize yourself with the terms of this Refund Policy, prior to doing online payment from Bin Dasmal General Trading Co. LLC website.

General Refund Conditions

This Refund Policy is subject to change by Us and in the event of any amendments, We shall make a suitable announcement on the Website. The changes will apply after We have given notice.

If You do not wish to accept the revised policy, You should not continue to use the Online Payment Service. If You continue to use the Service after the date on which the change comes into effect, your use of the Service indicates your agreement to be bound by the new Refund Policy.

Refund Processing Timeline:

Within five (5) working days of receipt of the Refund Request Form, We shall contact You to request any further information (if required) and You shall provide such information as soon as reasonably practicable. However, in any event no later than seven (7) working days following such request.

Within seven (7) working days following the receipt of any additional information requested by Us (or where no further information is requested, five (5) working days from receipt of Your Refund Request Form), We shall notify You by e-mail of the decision on whether You are eligible for a refund or not.

Refunds of Service Fees will be processed within fifteen (15) working days from the date of notifying You of the decision.

Receiving Your Refund

Refunds will be processed by the same method as payment was made. For example, if payment was made via the use of a credit or debit card, the refund will also be done via the same credit/debit card.

If Bin Dasmal General Trading Co. LLC is unable to process the refund by the same mode in which payment has been made, in such case Bin Dasmal General Trading Co. LLC will notify You, of an alternate mode of payment for processing such refund.

In case of payments by debit/credit card, the exact date by which the refund amount will be credited in the account of the customer’s bank card shall depend on the bank card issuer but not more than Thirty (30) calendar days.

Chargebacks

We expect You to contact Us to resolve any problem or issue related to your payment before You make any Chargeback request to your bank. This Section does not affect any rights which You may have against the issuer of a debit or credit card. We will investigate any Chargeback requests made by You and in response will inform Your Issuing Bank whether any services have been canceled.

Governing Law and Jurisdiction

Any related claims, differences, and disputes arising under or in connection with or in relation to this Terms and Conditions and hereto shall be governed and solved in accordance with the laws of the United Arab Emirates. Any conflicts submit to the non-exclusive jurisdiction of the Dubai, United Arab Emirates Courts.
